STEW LEONARDS AND COSTCO COULD CLOSE IF...

Judge John DiBlasi issued a landmark l09 page decision on the Austin Ave shopping center in Yonkers annulling the certificates of occupancy issues for Stew Leonards and Costco as well as ordering Yonkers and the developer, the Morris Companies, to complete certain road improvements by September l5,2003 (interchange 6A off the Thruway). And, the Judge also ruled that a SEQR review of traffic conditions must be completed by June 30,2004, including possible mitigation. If the environmental review and road improvements are not done the c/o for Stew Leonard's and Costco will be annulled. It's my hope that the court's decision will serve as a basis for a meaningful collaborative approach to resolve the traffic problems caused by the store, and finally seek an alternative access road for the project, said Greenburgh Supervisor Paul Feiner. We don't want to close down the stores. We want to work together toward a traffic solution.
