NOTICE OF SPECIAL ELECTION

NOTICE OF SPECIAL ELECTION,
Town of Greenburgh, Westchester County, New York
 
NOTICE IS HEREBY GIVEN that a special election of the Town of Greenburgh, Westchester County, New York, will be held at the polling place in each Town election district in the unincorporated area of the Town set forth below on the 6th day of November, 2012, at which the polls will be kept open between the hours of 6:00 o'clock A.M., and 9:00 o'clock P.M., Prevailing Time.  The polls will be kept open for the purpose of voting during the aforesaid hours and the proposition to be voted upon will be in substantially the following form, to-wit:
PROPOSITION NO. 1
 
Shall Town Board resolution TB-1, dated August 13, 2012, authorizing a lease agreement with Game On 365, LLC to construct a temporary recreation/sports bubble and related appurtenances and to operate a private entrepreneurial multi-purpose sports facility on the old Frank’s Nursery property at 715 Dobbs Ferry Road, for a period of fifteen years upon the issuance of a Certificate of Occupancy from the Town Building Department, generating revenue for the Town from a private enterprise, thereby reducing the amount that would otherwise be raised from Greenburgh taxpayers, of Gross Rent (Net Rent plus Property Taxes) for Year 1 of $260,000.00 per year, $280,000.00 per year for Year 2, $300,000.00 per year for Year 3 and $325,000.00 per year for Year 4, with Game On 365, LLC, paying the full amount of Property Taxes as part of the Gross Rent; and a Net Rent of $172,000.00 in Year 5, or the Net Rent in Year 4 increased by 1% in Year 5, whichever is greater, and, for the remainder of the 15 year lease, a Net Rent which is 1% greater than the prior year’s Net Rent, in addition to the full Property Taxes due on the Property, and in addition to a one-time payment of $125,000.00 by Game On 365, LLC for an environmental study of the property and remediation, if necessary, be approved?
 
 
The lease described above has been determined to be an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which, as proposed, the Town Board has determined will not result in any significant environmental effects.
NOTICE IS HEREBY FURTHER GIVEN, that persons qualified to vote at such special election shall, except as otherwise provided in the following paragraph with respect to personal registration, be electors of the Town of Greenburgh, Westchester County, New York, residing in the unincorporated area of the Town, being the area of the Town located outside of the Villages of Ardsley, Dobbs Ferry, Elmsford, Hastings-on-Hudson, Irvington and Tarrytown.
NOTICE IS HEREBY FURTHER GIVEN, that personal registration is required and any such elector shall not be entitled to vote at said special election unless his or her name appears on the register of the Town or such elector registers as hereinafter provided.  All electors currently registered to vote with the Westchester County Board of Elections under the provisions of Article 5 of the Election Law need not register again for such special election.

A list of all qualified electors to whom absentee ballots have been issued will be available for public inspection at the Office of the Town Clerk during regular office hours until the day of the election.  Any qualified elector may, upon examination of such list, file a written challenge to the qualifications of any elector to receive an absentee ballot, stating the reasons for such challenge.  Such written challenge shall be filed with the Town Clerk who will transmit the same to the Inspector of Election prior to the close of the polls.
