How to file a claim for damages against NYS if you hit a pothole and ruin your tire on a NYS road

You may file a small claim with the New York State Department of Transportation. Below is a link to the Department’s website where you may get further information and forms required.  NYS roads within Greenburgh include:

Dobbs Ferry Road 100 B, Grasslands Road 100C, Saw Mill River Road, Knollwood, West Hartsdale Ave, Hillside, Route 119, and Central Ave.

If you hit a pothole on a town road you need to file a claim with the Town Attorney’s office. To collect reimbursement in NYS – a resident must prove that the government had pre existing written notice of the pothole and did nothing.

The steps we take –planning a new sidewalk…

The Town is planning to construct sidewalk along Fair Street from Gibson Avenue to Juniper Hill Road to improve pedestrian safety and provide residents with opportunities to walk in a comfortable setting.  This past Saturday, May 12, I met with members of the Juniper Hill Civic Association, along with Victor Carosi, P.E., Commissioner of Public Works, and Jim Meehan, one of our town engineers. We conducted a site visit along Fair Street where we discussed the planned location of the sidewalk and heard the residents’ concerns. Photos of our walk can be found below.

As part of the design process, our engineering staff incorporates various factors including site location, pedestrian accessibility, topographic data and utility locations into the design decision matrix. Our engineering staff attempts to balance all of these factors while following federal highway guidelines (for ADA compliance) and while trying to minimize impacts to local residents. We have to appropriate funds for the sidewalk, go out to bid. From start to finish the process usually takes close to two years.

In recent years we have overseen the construction of  new sidewalks at Seely Place, Fort Hill, parts of Secor, Benedict Ave, Knollwood, near Solomon Schecter on W Hartsdale Ave, parts of Central Ave,  parts of Dobbs Ferry Road, Hillcrest. A new sidewalk will be constructed this year on Columbia Ave. Much more needs to be done.   Sidewalks are very expensive to build so we are building them gradually. We have received some grants in the past from NYS (Central Ave, Secor). Developers have also contributed to the sidewalk construction near their developments (Benedict, W Hartsdale Ave, parts of Central Ave, Dobbs Ferry Road, Knollwood)
